Delhi High Court granted regular bail to Senior Journalist Upendra Rai in one case out of the two FIRs registered against him in May 2018. The other FIR (RC217218A0003) too loses its sanctity. As per the legal opinion sought from Ministry of Law and Justice the above case is not fit for sanction of prosecution of Public Servant and the prosecution was denied by CVC also. Therefore, a clean chit in this case has been given to Upendra Rai that this case is not maintainable under PC Act.
With reference to the denial letter from Under Secretary, Govt. of India to CBI, Special Court of CBI, Patiala House has removed PC Act in FIR no. RC217218A0003 and did not find any case of criminality or involvement of any Public Servant. Therefore, Special Court of CBI, Patiala House has marked the matter to Chief Metropolitan Magistrate to look into the maintainability of other charges.
